Supreme Court of Appeal technically okays Salima-Lilongwe water project

Justice of Appeal Dingiswayo Madise has granted a stay order on an injunction obtained by the Forum for National Development (FND) against the government of Malawi. The injunction was intended to prevent the government from securing a K105 billion loan for the Salima-Lilongwe water project. With the stay order, the National Bank of Malawi and NBS Bank can proceed with lending Khato Civils Limited the money for the project on behalf of the government.

Justice Madise’s ruling includes conditions for the applicant, Attorney General Thabo Chakaka Nyirenda, who is representing the government. The conditions state that the applicant should file a fresh application within seven days, and the hearing of the summons will be conducted within 21 days.

The totality of the stay order means that if Khato Civils is granted the money, of which this is the essence of this order,  the project to tap water from Lake Malawi to supply the city of Lilongwe will commence, much to the delight of Lilongwe dwellers.
