Judicial corruption as ACB nabs Dowa Magistrate Mpakati & Prosecutor Maganga

The Country’s corruption-busting body, the Anti-Corruption Bureau (ACB) has arrested second-grade Magistrate Davie Mpakati in Mponela, Dowa alongside Police Prosecutor James Maganga for demanding K400,000.00 from a suspect in order to rule in his favour in a theft case that he was answering.

In a statement signed by ACB spokesperson Egrita Ndala, the bureau on

28th March 2023 received a complaint alleging that Mr. Davie Mpakati Second Grade Magistrate in Mponela and Mr. James Maganga Police Prosecutor of Mponela Police Station were demanding K400,000.00 from a suspect in order to rule in his favour in a theft case that he was answering. The allegation went on to say that the two had also received MK300,000.00 from the suspect as bail bond but only issued a receipt of K50,000.00

“Bureau investigations established that Magistrate Davie Mpakati and Police Prosecutor Maganga demanded and received various sums of money from relatives of the suspect in order to release him on bail and later give him a suspended sentence respectively. The Bureau also established that the two received K200,000.00 before the Magistrate passed the suspended sentence to the convict,” reads the statement in part.

The Bureau with assistance from Malawi Police Service on Friday arrested Magistrate Mpakati and Police Prosecutor Maganga.

“They will be taken to court after the Bureau has recorded caution statements from them,” concludes the statement.
